EVENT TERMS AND CONDITIONS

The terms and conditions set out below constitute a binding contract between Dark Sky Festival (Promoter) and the event patron. The terms and conditions apply to the person purchasing the ticket, patrons attending the event and any subsequent ticket holders or recipients of an event Ticket.

Entry to the event is at your own risk.

The Venue and Promoter reserve the right to refuse entry.

Tickets are subject to availability. The Promoter reserves the right to release availability without notice.

Strictly no refunds or exchanges, except in accordance with Live Performance Australia’s Ticketing Code of Practice and consumer law. Refunds will be at the discretion of the event promoter.

The Event shall proceed “rain or shine” unless conditions become dangerous. If the Event is cancelled all patrons are eligible for a refund and details of the refund process will be communicated via Moshtix.

Should the event cancel or reschedule, patrons will be contacted by Moshtix.

The Promoter reserves the right to withdraw, reschedule or substitute artists/talent/speakers and/or vary advertised event time and inclusions without notice. The Venue is a licensed venue. Alcoholic beverages must not be taken into or out of the Venue.

All menus are subject to change. Special dietary requirements are limited and need to provided to the Promoter at the time of booking through Moshtix. The  Promoter takes no responsibility for unspecified allergies.

Tickets may not be offered for resale through third-party websites (such as Viagogo).

Tickets may not be resold or offered for resale at a premium.

Tickets may not be used for advertising, promotion, or other commercial purposes without approval from the Promoter.

If a ticket is in breach of these conditions, it may be cancelled without refund and the bearer of the ticket may be refused admission.

Unauthorised sale or ticket duplication will result in refusal of entry to the event. If duplicate tickets present at entry, the Promoter reserves the right to refuse entry to all ticket holders (including original account holder).

This site will link you to an external platform (Moshtix) to process the transaction. Upon purchase you accept and agree to the Moshtix Privacy Policy and Terms & Conditions.

You must follow all reasonable directions of the Promoter and Venue staff.

The Promoter and the Venue shall not be held liable for any loss, injury, or damages sustained entering or within the venue, whether caused by the negligence of the Promoter or the venue or otherwise.

All persons, articles of clothing, bags and containers are subject to a full search at entry to ensure safety.

Prohibited items will be confiscated (These items may be disposed of or returned post-event at the discretion of the promoter). • Alcohol

Cans/glass
Chairs of any sort
Whistles/horns/drums
Professional cameras, audio recording equipment or video cameras
Large or hard eskies, baskets or boxes
Umbrellas or shade structures
Flags/banners/items
Items that in the opinion of the Promoter and Venue could cause harm or public nuisance.

Dark Sky Festival is a smoke-free event.

No animals are permitted in the event. Authorised medical assistance animals are an exception but must be approved prior to the event by contacting  info@mellenevents.com

No professional cameras (such as an SLR), professional video camera (including go pro’s), sound recording devices or lighting equipment are permitted in the event.

Ticket holders’ consent to filming and sound recording as members of the festival

In the event of an emergency evacuation or situation, you must follow all official directives.

This event will be run in accordance with applicable Government directions, orders, regulations, or guidance associated with COVID-19 in place at the time of the event, which is fluid and may change. Unless required by applicable law, refunds will not be required as a result of following the conditions of or changes to any applicable Government directions, orders, regulations or guidance associated with COVID-19.

Any intimidating or dangerous activities will not be tolerated and will result in ejection from the event, without the right to re-entry or refund. This includes posturing or “surrounding” patrons, aggressive moshing, stage diving, crowd surfing or climbing. The Promoter accepts no liability for any injuries or damages caused by these activities.

The Promoter and the Venue will not take responsibility or liability for any personal property lost or damaged at the event, including cloaked items. Any lost property items handed into Lost & Found will be held for one (1) day post-event only.

The Promoters or the event will not be held liable for any hearing damage or loss. Please use earplugs if necessary.

Please be aware that smoke, pyrotechnics, lasers, and strobe lighting may be in use.

If you are evicted from the event or refused entry, your ticket will be cancelled, and you will not be entitled to a re-entry or refund.

The promoter may amend the terms and conditions at any time by updating it online without notice. Any variations will only apply to ticket purchases made after the terms have been updated. If you cannot comply with the terms and conditions, then you must not make a purchase.

Patrons enter the Event Venues at their own risk and neither The Promoter or Venue will be liable for any injury, loss or damage suffered or incurred.
